PLEASE READ THIS TRADING SERVICE AGREEMENT (“AGREEMENT”) CAREFULLY BEFORE USING THE TRADING FEATURES PROVIDED BY CARDKETCH (“WE,” “US,” OR “OUR”). BY ACCESSING OR USING THE CARD TRADING FEATURE, YOU (“USER” OR “YOU”) AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS CONTAINED HEREIN. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE TRADING FEATURE.

1. Trading at Your Own Risk

Peer-to-Peer Interactions: The trading feature provides a platform for users to connect and negotiate trades directly with one another. We do not act as a seller, buyer, broker, or agent in any transaction.

Assumption of Risk: You acknowledge and agree that all trades are conducted entirely at your own risk. You assume full responsibility for evaluating, verifying, and accepting any trade proposal.

2. Disclaimer of Warranties & Item Verification

No Verification: CardKetch does not inspect, verify, grade, authenticate, or guarantee the existence, condition, value, legality, or delivery of any physical or digital cards offered for trade.

“As-Is” Feature: The trading feature is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CARDKETCH, ITS FOUNDERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• ANY TRADE, TRANSACTION, OR INTERACTION CONDUCTED THROUGH THE PLATFORM;
• ANY FRAUDULENT ACTIVITY, SCAMS, NON-DELIVERY, OR MISREPRESENTATION BY OTHER USERS;
• COUNTERFEIT, DAMAGED, OR STOLEN ITEMS;
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRADES OR TRANSMISSIONS.

4. User Disputes & Fraud Policy

Direct Resolution: Disputes arising from a trade—including missing items, damaged condition, or non-fulfillment—must be resolved directly between the trading parties involved. CardKetch has no obligation to mediate, resolve, or provide financial reimbursement for user disputes or scams.

Account Enforcement: While we hold no financial or legal liability for disputes, we reserve the right (at our sole discretion) to investigate reported abuse and suspend, terminate, or ban accounts found engaging in scams, fraud, or deceptive behavior.

5. Indemnification

You agree to defend, indemnify, and hold harmless CardKetch and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your use of the trading feature or your violation of this Agreement.
